MakePay Terms of Service
Terms for using MakePay websites, hosted checkout, embedded checkout, APIs, plugins, and merchant payment tools.

Agreement
These Terms of Service apply when you access MakePay websites, hosted checkout, embedded checkout, APIs, commerce plugins, documentation, support, or merchant payment tools. By using MakePay, you agree to these terms. If you use MakePay for a company or other organization, you represent that you are allowed to accept these terms for that organization.
Some merchants, partners, or platform users may have a separate written agreement with MakePay or MakeCrypto. If there is a conflict between these public terms and a signed written agreement, the signed written agreement controls for that relationship.
Service
MakePay provides software for crypto payment links, hosted checkout, embedded checkout, deposits, subscriptions, payment status, webhooks, APIs, and commerce integrations. MakePay helps merchants create and manage checkout flows, but merchants remain responsible for their products, services, prices, customers, refunds, tax, accounting, compliance, and support.
MakePay is not a bank. MakePay does not promise that any crypto asset, chain, wallet, route, quote, settlement path, or third-party service will always be available. Availability may change because of liquidity, network conditions, sanctions controls, security issues, maintenance, third-party providers, or legal and operational requirements.
Merchant responsibilities
Merchants are responsible for using MakePay only where allowed, maintaining accurate business and payment information, securing dashboard accounts and API credentials, configuring settlement and webhook settings correctly, publishing clear customer terms and refund policies, and responding to customer support questions.
Merchants must not use MakePay for illegal activity, sanctions evasion, fraud, deceptive practices, malware, stolen goods, unauthorized financial services, or activity that violates applicable law, network rules, third-party terms, or MakePay policies.
Payer responsibilities
Payers are responsible for reviewing the merchant, amount, asset, chain, wallet address, fees, and payment details before sending a crypto payment. Crypto transactions may be irreversible after they are broadcast or confirmed. Payment mistakes, wrong-chain payments, underpayments, overpayments, refunds, and order questions should be handled with the merchant first unless MakePay support is needed for payment-status context.
Integrations and APIs
Developers must keep API keys, OAuth tokens, webhook secrets, and private keys secure. You may not abuse MakePay APIs, bypass rate limits, probe or disrupt systems, scrape non-public data, interfere with other users, or use MakePay to send malicious or misleading traffic.
Commerce plugins and SDKs are provided to help merchants connect MakePay to supported platforms. Merchants and developers remain responsible for testing their own stores, themes, extensions, checkout settings, and custom code before going live.
Fees and taxes
MakePay pricing, network fees, route costs, exchange rates, and third-party fees may vary by product, asset, chain, route, volume, account, or agreement. Merchants and payers are responsible for their own taxes, filings, invoices, receipts, and accounting.
Risk
Crypto assets and blockchain networks can be volatile, delayed, congested, forked, attacked, unavailable, or subject to technical, legal, liquidity, sanctions, market, and operational risk. You use MakePay with an understanding of those risks.
MakePay may suspend, limit, reject, or delay access to features, payment flows, routes, integrations, accounts, or support when needed for security, compliance, maintenance, abuse prevention, legal process, or service integrity.
Intellectual property
MakePay websites, documentation, product names, designs, logos, and software are protected by intellectual-property laws. Open-source plugins or SDKs are licensed under the license included with those packages. These terms do not give you ownership of MakePay brands or proprietary service technology.
Disclaimers
MakePay is provided on an as-is and as-available basis to the maximum extent allowed by law. We do not guarantee uninterrupted operation, error-free checkout, asset availability, route availability, merchant revenue, payment completion, settlement timing, or compatibility with every store, wallet, browser, plugin, theme, or third-party service.
Liability
To the maximum extent allowed by law, MakePay will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, crypto asset loss, market movement, or third-party failures. Nothing in these terms excludes liability that cannot be excluded by law.
Changes
We may update these terms as MakePay changes or legal, operational, security, or product requirements evolve. The effective date at the top of the page identifies the current version. Continued use of MakePay after an update means you accept the updated terms.
